PhysiqLab Terms & Conditions

These Terms & Conditions ("Terms") apply to all services provided by JJ Academy Pty Ltd (ABN 22 656 568 973), trading as PhysiqLab ("PhysiqLab", "we", "our", or "us"), including online coaching, training programs, nutrition coaching, and related support.

By purchasing, enrolling, applying, booking a consultation, or using our services, you agree to be bound by these Terms.

1. Services Provided

PhysiqLab provides online fitness and nutrition coaching services, which may include:

personalised training programming

personalised nutrition targets and coaching

check-ins and progress tracking

education and coaching resources

access to coaching platforms (e.g. Trainerize)

messaging support (e.g. WhatsApp)

accountability and habit coaching

Our services are educational and coaching-based and are not medical services.

2. Medical Disclaimer

PhysiqLab does not provide medical advice, diagnosis, or treatment.

You understand and agree that:

you should consult a qualified medical professional before starting any training or nutrition program

you are responsible for determining whether participation is safe for you

you must inform PhysiqLab of any injuries, medical conditions, pregnancy, or medications that may impact training or nutrition recommendations

If you experience pain, dizziness, faintness, injury, or any concerning symptoms, you should stop immediately and seek medical advice.

3. Eligibility

To use our services, you must:

be at least 18 years old, or have written consent from a parent/guardian

provide accurate and complete information

comply with all coaching instructions and safety guidance

not be participating in our services contrary to medical advice

We reserve the right to refuse service where participation may be unsafe.

4. Applications, Marketing Communications & Consultations

4.1 Application data

When you start or submit an application with PhysiqLab, we collect and store the personal information you provide, including your name and phone number.

By starting or submitting an application, you consent to PhysiqLab:

storing this information in our client and marketing database

contacting you to follow up on your application or consultation

sending you general marketing communications by phone, SMS, or email

You may opt out of marketing communications at any time by following the unsubscribe instructions in the message or contacting us at info@physiqlab.com.

4.2 Consultation call recording

By submitting or completing an application and booking a consultation call, you consent to your consultation call being recorded for training and compliance purposes.

Recordings are handled in accordance with our Privacy Policy.

5. Program Term & Delivery

Your coaching term begins on the start date agreed during onboarding and continues for the duration of your selected package (12 weeks, 24 weeks, or 52 weeks), unless terminated earlier under these Terms.

Each package is a minimum term commitment. By enrolling, you are committing to the full duration and full program fee of your selected package.

Coaching is delivered online. No in-person services are included unless agreed in writing.

6. Client Responsibilities

You agree that you are responsible for your results and participation.

You agree to:

follow the coaching plan to the best of your ability

complete required check-ins and progress updates

communicate honestly about adherence, challenges, and lifestyle factors

use proper technique and safe effort levels during training

inform us of injuries, medical changes, or major schedule changes

PhysiqLab is not responsible for outcomes where you do not follow the program or do not engage with the coaching process.

7. Payments, Billing & Pricing

All prices are listed in Australian Dollars (AUD) unless stated otherwise.

7.1 Payment options

PhysiqLab services are payable via:

an upfront payment for the full program fee, or

weekly payments across the duration of your minimum term.

Weekly payments are a payment schedule for your minimum term commitment, not a week-to-week subscription.

7.2 Payment authorisation

By selecting the weekly payment option, you authorise PhysiqLab (and our payment provider) to automatically charge the agreed amount each week for the duration of your minimum term.

7.3 Total commitment

Regardless of the payment structure selected, you are committing to the full program fee for your minimum term. The weekly option is a payment schedule, not a pay-as-you-go arrangement, and does not shorten or reduce your commitment.

If your payment schedule is cancelled or fails before the full program fee is paid, the remaining balance becomes payable in accordance with these Terms.

8. Failed Payments & Non-Payment

If a payment fails or is missed:

we may attempt to reprocess payment automatically

your access to coaching services may be paused until payment is successfully processed

ongoing missed payments may result in termination of services

You remain responsible for paying the full program amount for the agreed term unless otherwise required by Australian Consumer Law.

9. Cancellation, Pausing, and Transfers

9.1 Minimum Term & Early Cancellation

All packages are minimum term commitments. PhysiqLab does not offer refunds or early release for change of mind.

You may request early cancellation in writing. Early release from your minimum term is granted at PhysiqLab's discretion, and may be considered in cases of serious and unforeseen circumstances (such as significant medical events), with supporting evidence.

Unless PhysiqLab agrees in writing to an early release, you remain responsible for the full program fee for your minimum term, and weekly payments will continue until the term is complete or the balance is paid.

Nothing in this clause limits your rights under Australian Consumer Law.

9.2 Pausing Coaching

If you need to pause due to illness, injury, travel, or major life events, you may request a pause in writing.

Pauses are granted at PhysiqLab's discretion and are not guaranteed. If a pause is granted, your coaching term is extended by the number of weeks paused.

9.3 Transfers

Coaching packages are not transferable to another person.

10. Refunds & Australian Consumer Law

PhysiqLab complies with the Australian Consumer Law (ACL).

You are entitled to a refund, replacement, or compensation where required under ACL, including where services are not delivered with due care and skill or are not provided as described.

Except as required by law or explicitly stated under a guarantee, all payments are non-refundable.

11. Results Disclaimer

You acknowledge and agree that:

individual results vary significantly

PhysiqLab does not guarantee specific outcomes unless explicitly stated under a written guarantee

results depend on individuals experience, adherence, nutrition tracking compliance, lifestyle, medical history, effort, sleep, stress, and other factors outside our control

12. PhysiqLab 8kg Guarantee

12.1 Eligibility

The PhysiqLab 8kg Guarantee applies to 24 week and 52 week packages.

The guarantee does not apply to 12 week packages unless offered by PhysiqLab in writing, at our discretion, on a client-by-client basis.

12.2 The guarantee

If you follow your coaching program as designed and do not lose a minimum of 8kg of body weight over your program term, you may choose either:

a full refund of your program fee, or

continued coaching at no additional cost until you achieve a minimum 8kg loss.

12.3 Compliance requirements

The guarantee applies only if you meet all compliance requirements. Unless otherwise stated in writing, this requires:

completion of all weekly check-ins

adherence to nutrition targets, with accurate food entries, within reasonable tolerance

completion of prescribed training sessions

achievement of a minimum step/activity target (if prescribed)

accurate tracking of body weight and progress data

no major undisclosed medical conditions impacting weight loss

no extended absences, unreported injuries, or non-engagement

Compliance requirements continue to apply during any extended coaching period under this guarantee.

Proof of compliance may be required, including screenshots or logs from coaching platforms.

PhysiqLab reserves the right to assess compliance fairly and reasonably.

13. Communications & Response Times

PhysiqLab provides support via the channels stated during onboarding (e.g. Trainerize messaging, WhatsApp, email).

We aim to respond within 1–2 business days.

Support is not guaranteed outside business hours, on weekends, or on public holidays.

14. Client Conduct

You agree to communicate respectfully and professionally.

PhysiqLab may terminate services immediately without refund if you:

harass, abuse, or threaten staff

behave in a discriminatory, unsafe, or inappropriate manner

engage in dishonest or fraudulent behaviour

misuse our systems or attempt to access another client's data

15. Intellectual Property

All PhysiqLab materials are protected intellectual property, including:

training programs

nutrition resources

videos and exercise tutorials

meal plans, recipes, and coaching documents

branding, logos, and design assets

You may not copy, reproduce, share, distribute, or resell any PhysiqLab materials without written permission.

16. Privacy

PhysiqLab collects and handles personal information in accordance with our Privacy Policy, available at:

17. Limitation of Liability

To the maximum extent permitted by law:

PhysiqLab is not liable for any indirect, incidental, special, or consequential loss

PhysiqLab is not liable for injury, illness, or damages arising from participation in training or nutrition changes. You accept all risks associated with exercise and dietary change

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under Australian Consumer Law that cannot be excluded.

18. Termination of Services

We reserve the right to suspend or terminate services if you breach these Terms, including non-payment or misconduct.

Termination does not remove your obligation to pay outstanding fees, except where required by law.

19. Changes to These Terms

We may update these Terms from time to time. The latest version will be available at:

20. Governing Law

These Terms are governed by the laws of Queensland, Australia.
